David Bain was originally found guilty of murdering his parents, two elder sisters and younger brother. He served close to 13 years in prison.
At a subsequent retrial he was found not guilty beyound a shadow of a doubt. He has never been found innocent or proven his innocence.
A retired Canadian judge was given the task to reconsider the case; he has recommended compensation for David Bain. But compensation should only be granted if the NZ Government is certain that David Bain is innocent. But they cannot be certain because they have not found any other suspect who could have killed the family. It was found that Robin Bain's late father could not have committed suicide.
